General terms and conditions of sale

These terms and conditions govern purchases from the Bodegas Carpe Diem online shop. Please read them before placing your order: by confirming it, you declare that you have read and accept them.

1. Who is selling to you

S.Coop.And. Agrícola Virgen de la Oliva (SCAAVO), CIF F29038908, with registered address at Avenida de las Américas, 35 – 29532 Mollina (Málaga). Telephone 952 74 01 00 (Monday to Friday, 8:00 to 17:00). Email: tienda@scaavo.com.

2. Over-18s only

We sell alcoholic beverages, so only people aged 18 or over may buy from us. By placing an order you declare that you are of that age. We may ask you to prove it, and the courier may ask for proof of identity on delivery; we will not deliver orders to minors. If we find that the buyer is under 18, we will cancel the order and refund the amount paid.

3. Products and prices

We show the main characteristics of each product on its product page. Photos are for guidance only: the vintage or label may vary slightly. Prices are in euros and include VAT. Shipping costs are shown separately before payment. The applicable price is the one shown at the time you confirm your order.

4. How to buy

Add the products to your basket and click “Checkout”. You can buy without creating an account.
Enter your details and choose home delivery or free collection from the winery.
Check the summary (products, shipping costs and total), accept these terms and conditions and pay.
We will send you an email confirming your order. The contract is concluded when you receive that confirmation.

You can correct your details before paying. The contract can be concluded in Spanish, English, German or French. We keep a copy of your order, which you can ask us for at any time.

5. Shipping: within Spain only

We only ship to addresses in Spain: mainland Spain, the Balearic Islands, the Canary Islands, Ceuta and Melilla. We do not ship abroad.

Shipping costs depend on the weight of the order and the destination, and are calculated in the basket before payment:

Mainland Spain: from €4.35.
Balearic Islands, Canary Islands, Ceuta and Melilla: from €6.21.
Free shipping on orders of €150 or more.
Collection from the winery: free, Monday to Friday from 8:00 to 14:00. We will let you know by email when your order is ready for collection at Avenida de las Américas, 35, Mollina.

Bag-in-box formats have different shipping costs because of their weight. Shipments to the Canary Islands, Ceuta and Melilla may be subject to the import taxes or formalities that apply in those territories; if so, we will tell you before you complete your order.

The usual delivery time is 24 to 72 working hours from order confirmation; for the islands, Ceuta and Melilla it may be slightly longer. In no case will it exceed 30 calendar days. If we are unable to supply a product, we will let you know and refund what you paid for it.

6. Payment

You can pay by debit or credit card or with Bizum, through the secure Redsys payment gateway. The charge is made when you confirm the order. The transaction is authenticated by your bank, and SCAAVO never sees or stores your card details.

7. If your order arrives damaged

Check the parcel when you receive it. If you notice any knocks, breakages or damp, note it on the courier's delivery note or refuse the delivery. Let us know as soon as possible, ideally within the first 24-48 hours, at tienda@scaavo.com or on 952 74 01 00, with your order number and photos of the packaging and the product. We will send you the product again or refund its price, at no cost to you. This prompt notice helps us handle the transport insurance, but it does not limit your warranty rights.

8. Right of withdrawal (returns)

You have 14 calendar days from the day you receive your order to withdraw from the purchase without giving any reason. To do so, let us know clearly by email to tienda@scaavo.com, by post or using the form at the end of these terms and conditions.

Return the products to us within 14 calendar days of notifying us of your decision, unopened and in good condition, in their original packaging if possible. You can also bring them to the winery.
You will bear the direct cost of returning the products, unless the product is faulty or is not what you ordered.
We will refund everything you paid, including the initial standard shipping cost, within 14 calendar days of your notifying us of the withdrawal, using the same payment method you used. We may wait until we have received the products or until you have provided proof that you have sent them back.
You will be liable for any loss in value of the products resulting from handling other than what is necessary to establish their nature and characteristics.

Exceptions (Article 103 of the consolidated text of the Spanish General Law for the Defence of Consumers and Users, texto refundido de la Ley General para la Defensa de los Consumidores y Usuarios): sealed bottles or other sealed containers that have been opened after delivery cannot be returned, as they are not suitable for return for reasons of health protection and hygiene; nor can products made to your specifications or personalised at your request.

9. Warranty and defects

All our products come with the legal guarantee of conformity established by law (three years from delivery). If a product is defective or does not match what you bought, write to us and we will replace it or refund its price, at no cost to you.

10. Club Carpe Diem

Club Carpe Diem is a quarterly subscription: every quarter we send you 3 wines chosen by our winemaker for €39 per quarter, shipping included (within Spain only). The first quarter is paid when you join; the following ones are charged to the same card on 6 January, April, July and October. There is no minimum term: you can cancel whenever you like from your account or by writing to tienda@scaavo.com, and you will not be charged for any further quarters. If you cancel by the 5th of January, April, July or October, you will not be charged for that quarter. The right of withdrawal applies to each shipment under the terms of section 8.

11. Customer service and complaints

For any questions, issues or complaints, write to us at tienda@scaavo.com or call us on 952 74 01 00, Monday to Friday, 8:00 to 17:00. We will reply as soon as possible and, in any event, within the legal time limit. Official complaint forms (hojas de quejas y reclamaciones) of the Junta de Andalucía (the regional government of Andalusia) are available to you: you can ask us for them or submit them electronically. You can also contact the consumer affairs services of your autonomous community (region).

12. Applicable law

These terms and conditions are governed by Spanish law. If you are a consumer, the courts of your place of residence will have jurisdiction over any dispute.
